Terms of Service

These Terms of Service ("Terms") govern your use of Pinbluu's mobile application and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (16 in the European Economic Area) to use the Service. By using the Service, you represent that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that you have not been previously banned from the Service.

2. Your Account

You are responsible for:

• Providing accurate registration information
• Keeping your password confidential
• All activity that occurs under your account
• Notifying us immediately if you suspect unauthorized access

You may not impersonate another person, create multiple accounts to circumvent enforcement actions, or transfer your account to another person without our permission.

3. Acceptable Use

You agree not to use the Service to:

• Post content that is illegal, fraudulent, harassing, threatening, hateful, or sexually explicit
• Post content involving the exploitation or endangerment of minors
• Infringe anyone's intellectual property, privacy, or other rights
• Impersonate any person or organization
• Distribute spam, malware, or unauthorized advertising
• Scrape, crawl, or programmatically access the Service without our permission
• Interfere with the Service's normal operation or attempt to bypass security measures
• Use the Service to violate any applicable law, including in your jurisdiction or in the jurisdiction where your content is posted

We reserve the right to remove content and suspend or terminate accounts that violate these Terms, with or without notice.

4. Your Content

You retain ownership of the content you create on the Service (your spots, photos, videos, comments, messages, and trip plans). However, by posting content to the Service, you grant Pinbluu a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, reproduce, adapt (for technical purposes such as resizing or transcoding), and distribute that content for the purpose of operating, providing, and promoting the Service.

This license ends when you delete your content or your account, except where we are legally required to retain the content or it has been shared with others who have not deleted it.

You represent that you own or have the necessary rights to all content you post, and that your content does not violate anyone's rights.

5. Other Users' Content

The Service contains content created by other users. We do not endorse or take responsibility for the accuracy, legality, or quality of user-generated content. You access and rely on such content at your own risk.

6. Ads and Wallet Credits

The Service allows users to create paid promotional content ("ads") using credits in their Pinbluu wallet. Ad credits:

• Have no cash value and are not refundable except where required by law
• Are non-transferable between accounts
• May be revoked if obtained through fraud or in violation of these Terms
• Are subject to ad review and approval; we may reject or remove ads at our discretion

7. Trip Plans and AI Features

The Service offers AI-generated trip plans powered by third-party AI providers. AI-generated content:

• May contain errors, inaccuracies, or outdated information
• Is not a substitute for professional travel advice
• Should be independently verified before you act on it

You are responsible for confirming details like opening hours, prices, visa requirements, and safety conditions before traveling.

8. Intellectual Property

The Service, including its software, design, logos, and trademarks, is owned by Pinbluu or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use Pinbluu trademarks without our prior written permission.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Service

Upon termination, the provisions of these Terms that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that the Service will be available at all times or that any errors will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, Pinbluu and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill arising out of or related to your use of the Service. Our total aggregate liability for any claim related to the Service will not exceed the greater of (a) the amount you have paid us in the past 12 months, or (b) USD $50.

12. Indemnification

You agree to indemnify and hold Pinbluu harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

13. Changes to the Service or Terms

We may modify or discontinue the Service at any time. We may also update these Terms; when we make material changes, we will notify you through the Service or by email. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to its conflict-of-law principles. Disputes arising out of or related to these Terms or the Service will be resolved in the competent courts of Riyadh, Saudi Arabia, unless applicable consumer protection law in your country requires otherwise.

15. Apple and Google App Store Terms

If you downloaded the Service from the Apple App Store or Google Play Store, your use is also subject to those stores' applicable terms. In the event of conflict, these Terms apply except where the store's terms expressly override them.
